Welcome to Fandom Snacks! The terms "we", "us" and "our" refer to Fandom Snacks GmbH. Fandom Snacks GmbH operates this shop and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a personalized shopping experience (the "Services"). Fandom Snacks GmbH uses Shopify as its technical platform.
The following Terms and Conditions describe your rights and obligations when using the Services. Please read these Terms carefully. By visiting, using or purchasing through our Services, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.
1. Access and Account

2. Right of Withdrawal

Effects of Withdrawal
If you withdraw from this contract, we shall reimburse you all payments received from you, including the costs of delivery (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. You shall send back or hand over the goods without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us.
Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to goods which are liable to deteriorate or expire rapidly, or to sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
3. Our Products
We have made every effort to display our products and services in our online shop as accurately as possible. Colors and the appearance of products may vary depending on the device you use and its settings. We do not guarantee that the quality of any products purchased will meet your expectations.
All product descriptions may be changed at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and to limit the quantities of products offered.
4. Orders
By placing an order, you submit an offer to purchase. Fandom Snacks GmbH reserves the right to accept or reject your order at its sole discretion. Your order is not deemed accepted until it has been confirmed by Fandom Snacks GmbH. Acceptance of your order is subject to receipt and processing of your payment.
You represent that your purchases are generally intended for personal or household use. Commercial purchases, resale or export are only permitted where expressly agreed in writing between the parties or individually authorized in writing by Fandom Snacks GmbH. Fandom Snacks GmbH reserves the right to reject or cancel orders that are evidently intended for commercial resale without a corresponding agreement.
5. Pricing and Payment
Prices, discounts and promotions may be changed at any time without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be stated in the order confirmation email. Prices do not include taxes, shipping, handling or import fees unless expressly stated otherwise.
You represent that (i) the payment information you provide is true, correct and complete; (ii) you are authorized to use the payment method; (iii) charges incurred by you will be honored by your payment service provider; and (iv) you will pay all charges incurred at the prices indicated, including shipping and taxes.
6. Shipping and Delivery
We are not responsible for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events beyond our control. Title to and risk of loss for the products pass to you once we hand the products over to the carrier.

Our Services, including all text, displays, images, graphics, video and audio files and the design, selection and arrangement thereof, are owned by Fandom Snacks GmbH, its affiliates or its licensors and are protected by the laws of the Federal Republic of Germany, EU law and international copyright and trademark laws.
Fandom Snacks GmbH uses trademarks and intellectual property of third parties under valid license agreements. The following trademarks are the property of their respective owners and are licensed to Fandom Snacks GmbH:
– Tetris® is a registered trademark of Tetris Holding, LLC.
– Pac-Man® is a registered trademark of Bandai Namco Entertainment Inc.
– Space Invaders® is a registered trademark of Taito Corporation.
The use of these trademarks by Fandom Snacks GmbH is solely within the scope of valid license agreements. These Terms and Conditions grant the user no rights whatsoever in these third-party trademarks.
The Fandom Snacks™ brand, logo and all associated product and service names, designs and slogans are trademarks of Fandom Snacks GmbH or its affiliates. Their use without prior written permission is prohibited.
These Terms and Conditions permit the use of our Services for personal, non-commercial purposes only. Without our prior written consent, no content may be reproduced, distributed, modified, publicly displayed, transmitted, downloaded or stored. All rights not expressly granted are reserved by Fandom Snacks GmbH.
8. Online Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board, but we will always endeavor to find an amicable solution. Please contact us directly if you experience any issues.
9. Disclaimer of Warranties
The Services and all products offered through the Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted, secure or error-free use of the Services.
To the fullest extent permitted by law, Fandom Snacks GmbH, Shopify and their respective affiliates shall not be liable for any indirect, incidental, consequential or punitive damages arising from your use of the Services or any products purchased through the Services.
10. Privacy
All personal data collected through our Services is subject to our Privacy Policy, which is available on our website and forms part of these Terms and Conditions. These Terms and Conditions and all legal relationships arising therefrom are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and private international law.
For consumers: Mandatory consumer protection provisions of the country in which the consumer is habitually resident shall remain unaffected insofar as they are more favorable to the consumer.
For merchants, legal entities under public law and public-law special funds, Hamburg, Germany, is the exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms and Conditions, to the extent permitted by law.

We reserve the right to update or change these Terms and Conditions at any time. Changes become effective upon publication of the updated Terms on our website. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
